State Representative Bobby Franklin of Georgia introduced a bill in his state in 2011 that, if enacted, would require proof that a miscarriage occurred naturally. If a woman can’t prove that her miscarriage–or spontaneous abortion–occurred without intervention, she could face felony charges. Based on what you learned about pregnancy in this module, what are your views on this proposed legislation? Also, what are your views on the current legislation country-wide on this extremely sensitive topic?

Discussion 7: Pregnancy & Miscarriage
1
As a pro-life male who also believes in the value of personal autonomy and the
complexities of miscarriage, I have several thoughts about Representative Bobby Franklin’s
proposed bill from 2011 and the broader landscape of related legislation.
First, regarding the proposed bill requiring proof that a miscarriage occurred naturally,
while I understand the goal of preventing illegal abortions, this bill appears to be highly
problematic. Miscarriages are a common and often natural occurrence in pregnancies.
According to the American College of Obstetricians and Gynecologists (ACOG),
miscarriages occur in about 10% of known pregnancies, with the majority caused by
chromosomal abnormalities that are beyond anyone’s control. (Early pregnancy loss)
Requiring proof that a miscarriage occurred naturally places an undue burden on women who
are already dealing with a traumatic event. It could result in unnecessary investigations and
legal issues during a time of personal grief and medical recovery. The bill appears to lack a
fundamental understanding of the medical and emotional aspects of miscarriage.
From a pro-life standpoint, the sanctity of life is paramount, but so is compassion and
understanding of the complexities surrounding pregnancy and reproductive health. Penalizing
women for miscarriages, which are primarily natural and uncontrollable events, goes against
the compassionate side of the pro-life movement. It may also discourage women from
seeking medical care during a miscarriage for fear of legal repercussions, potentially
jeopardizing their health.
In terms of broader reproductive legislation, this is a highly sensitive and divisive
subject. Laws differ significantly between states and countries, reflecting diverse societal,
moral, and religious perspectives. As someone who values life, I believe it is critical to strike

a balance between protecting the unborn and respecting women’s autonomy and health needs.
This includes comprehending the complexities of pregnancy and the circumstances that force
women to make difficult decisions.
In conclusion, while I am pro-life, I believe it is critical to approach reproductive
legislation with a nuanced understanding of the medical, emotional, and ethical issues
involved. Laws like the one proposed by Representative Franklin appear to lack this nuance
and may cause more harm than good. Legislators must collaborate closely with medical
professionals and ethicists to develop policies that protect life while also respecting the
dignity and autonomy of women.
