  • Assume that you work for a healthcare organization with over four hundred employees specializing in workplace Wellness Programs. Your organization formed a Wellness Committee that drafted a proposed Wellness Lifestyle Policy (Policy). The Wellness Committee’s Charter states “Employers have the legal and ethical right to establish an employment-related policy that prohibits or limits an employee’s unhealthy behaviors outside the workplace. Since health care resources are finite, and costs of employer’s health insurance coverage continues to rise under the ACA, ensuring that employees have healthy lifestyles not only constitutes a legitimate employment consideration, but also fiscal responsibility.  “Employers need to be able to manage the nature of the health risk…the likelihood of disease occurrence from unhealthy lifestyle choice, and the health care costs that may result from tobacco use and weight related diseases. (Hammer and Knadig, 2017, p. 191)”.
  • The proposed draft policy seeks to prohibit unhealthy employee behaviors. Specifically, employees must fully disclose upon employment and periodically throughout continued employment their smoking, drinking, and eating habits, submit to monthly body fat assessments using the CDC guidelines, and participate in mandatory weekly exercise programs. Employees will also be expected to disclose adverse “active social lifestyle” information which includes the number and type of alcoholic beverage consumed on a weekly basis, recreational drug use (where such use is legal under state law), and the number and types of bars, restaurants, and nightclubs frequented. The Wellness Committee also reserved the right to make future amendments to the policy with respect to other yet undefined types of employees adverse “social lifestyle” habits. Under the proposed policy, employees must request advance, written permission from the employer prior to participating in any “extreme sports activities” as defined by the employer’s health insurance provider.  Once implemented, any violation of the policy or non-compliance by an employee could result in administrative action against the employee, to include termination of employment.
